the second year in a row, the california department of corrections and rehabilitation said it's seen a drop in rates. the latest number showed that during fiscal year 2007/2008, released inmates had a 63% resit vichl rate after three years. that's down from 65% the year before and from 67% in 2005/2006. present officials say the lower rates are in part due to recent rehabilitation efforts. >>> authorities are investigating a weekend crash that killed a young reyes car driver at the calistoga speedway. the sheriff's office says 20-year-old tyler wolf was wearing his helmet and seat belt when he crashed into a wall on saturday. this weekend's event was a 2-lap reyes celebrating the 75th anniversary of the speedway, which is a half mile dirt track. >>> the u.s. supreme court is set to decide late next month whether to hear the case on california's ban on same-sex marriage. asked the justices to overturn the decision in which an appellate judge in san francisco found the ban to be unconstitutional. the high court today posted a notice on its web site revealing that the case is on the age

coast of southern california. you can even see the cloud formation beginning to build a southerly swell so by tomorrow the coast will begin to cool down first and then that cooler air is going to trickle in. so today we're going to say the heat by tomorrow, though, a subtle change in the temperatures. first there will be a slight cool down followed by a bigger drop on wednesday and you can see the temperatures will continue to fall on thursday. meanwhile tomorrow morning we start out a lot like this morning. low 60s in the forecast with mostly clear skies. 52 degrees for san ra kel, 54 in oakland, 58 redwood city, 60 degrees san jose, 69 livermore and antioch we'll see a pretty quick warmup once again our inland spots will be warm once again. 91 in santa rosa tomorrow. low 80s sausalito. for the east bay 82 for oakland, 87 valley still near the cently mark in some cases. 91 san jose, 90 grooes for santa clara. along the peninsula a nicer day. 83 san mateo, 77 in san francisco. notice the coast for 60s to low 70s expected off pacifica down into bay and the widespread cooling comes

a shark has attacked a surfer off the california coast. today's attack happened off county coast at bunker surf spot in eureka not far from the airport there. this is a photo of the surfer's board and you can clearly see a large bight was taken out. witnesses say the 25-year-old man was bleeding profusely but made it out of the water by himself. he had at least four 12-inch gashes on his midsection and hip. remember it was one week ago today that a 39-year-old surfer died after he was attacked by sharks off the santa barbara coast. >>> a san francisco neighborhood has been put on alert after a series of encounters with aggressive ra coons. reporting the run ins with ra coons. most happen after dark but early one morning a baby ra coon fell out of a tree and its mother scratched a woman's dog. now, the department has put up warning signs, ordered ra coon resistant garbage cans and asked the woman who has been feegd wild animals in the park to stop. up next a live report from the jersey shore on the dire situation there. what's being done to help areas hard oes hit by the superstorm.

the governor of california : "all smoking in state owned buildings and leased spaces, including residence facilities, student apartments, students rooms, patio's and stairwells is prohibited". those who choose to smoke, must be outside and at least 25 feet away from doorways, stairs and groundlevel intake structures". but one smoking student, feels banning smoking outright is unfair "to have it really enforced, will actually kind of effect me, it would be a problem, i wouldnt know where to go". but for sophomore english major, lisa ramos, is 8 months pregnant, she hates that san jose state allows smoking on campus.
